CITY CARS RENTAL – VEHICLE RENTAL AGREEMENT & TERMS AND CONDITIONS

This Vehicle Rental Agreement (“Agreement”) is entered into between:

City Cars Rental

(“Company”, “we”, “us”)

AND

The Renter (“Renter”, “you”).

By signing this Agreement or taking possession of the vehicle, you agree to all terms below.

1. DRIVER ELIGIBILITY & LICENSE REQUIREMENTS

1.1 The Renter and any authorized driver must:

  • Hold a valid, unrestricted Class 5 driver’s license (or equivalent non-probationary license)
  • Be at least 21 years of age (or higher depending on vehicle class)1.2 The license must be valid, not suspended, expired, or revoked at any time during the rental period.

1.3 Only drivers listed in this Agreement are permitted to operate the vehicle.

2. VEHICLE USE RESTRICTIONS

The Renter agrees that the vehicle shall NOT be used:

  • For any illegal purpose or in violation of Alberta or Canadian law
  • While under the influence of alcohol, drugs, or impairing substances
  • For racing, off-road use, towing (unless authorized), or driver training
  • To transport hazardous or dangerous goods
  • For commercial use (rideshare, delivery, etc.) unless approved in writing

3. RENTAL PERIOD & KILOMETER LIMIT

3.1 The rental period is defined in the rental contract.

3.2 Mileage Limit:

  • Maximum 400 kilometers per day
  • Excess usage will be charged at $[X] per km

3.3 Late returns will incur additional daily charges and fees.

4. SMOKING & PET POLICY
4.1 Strictly No Smoking or Vaping in the vehicle.
4.2 No Pets Allowed in the vehicle unless explicitly authorized.
4.3 Violation will result in a cleaning/detailing fee of up to $[X].

5. PAYMENT, DEPOSIT & CREDIT CARD AUTHORIZATION

5.1 A valid credit card in the Renter’s name is required.

5.2 The Renter authorizes City Cars Rental to:

  • Charge the credit card for all rental fees, deposits, damages, penalties, and additional charges
  • Process charges after vehicle return, including delayed charges (tickets, tolls, damages, etc.)

5.3 A security deposit of $[X] will be held and may be used toward:

  • Damages
  • Late returns
  • Fuel shortages
  • Fines, tolls, or penalties

6. INSURANCE & LIABILITY

6.1 The Renter acknowledges:

  • Alberta law requires mandatory liability insurance (minimum $200,000)
  • Primary responsibility for damages and accidents lies with the Renter

6.2 Unless covered by purchased protection (CDW) or valid third-party insurance:
The Renter is fully liable for all damages, loss, or theft

6.3 The Renter is responsible for:

  • Loss of use
  • Diminished value

Administrative and repair costs

7. ACCIDENTS, DAMAGE & REPORTING

7.1 In case of accident:

  • Notify City Cars Rental immediately
  • Report to police where required
  • Complete all incident reports

7.2 Failure to report may result in full liability.

8. FINES, TOLLS, TICKETS & VIOLATIONS

8.1 The Renter is fully responsible for:

  • Traffic tickets
  • Parking violations
  • Photo radar tickets
  • Tolls and administrative fees

8.2 The Company may:

  • Charge the Renter’s credit card for all such costs
  • Apply an additional administration fee of $[X] per violation

9. VEHICLE CONDITION & RETURN

9.1 The vehicle must be returned:

  • In the same condition as received (reasonable wear excepted)
  • With the same fuel level

9.2 The Renter is responsible for:

  • Any new damage not recorded at pickup
  • Cleaning fees if vehicle is excessively dirty

10. TERMINATION & REPOSSESSION

The Company reserves the right to terminate the rental and repossess the vehicle without notice if:

  • Terms are breached
  • The vehicle is used unlawfully
  • Payment is not authorized

The Renter remains liable for all costs associated with repossession.

11. INDEMNIFICATION

The Renter agrees to indemnify and hold harmless City Cars Rental from all claims, damages, liabilities, and legal costs arising from:

  • Use or misuse of the vehicle
  • Violations of this Agreement
  • Third-party claims

12. PRIVACY

The Renter consents to collection and use of personal data for:

  • Identity verification
  • Payment processing
  • Legal compliance

13. GOVERNING LAW

This Agreement shall be governed by the laws of:

  • The Province of Alberta
  • The City of Calgare

14. ENTIRE AGREEMENT

This document constitutes the full agreement between the parties and overrides any prior agreements.
